Don Imus is expected to file a $40 million lawsuit against CBS next week, accusing it of breach of contract, the New York Times reported on its Web site.The radio division of CBS dropped Imus because of remarks he made in reference to a women's college basketball team. The paper cited Imus's lawyer, Martin Garbus, as alleging that CBS violated a clause in the radio shock jock's contract that encouraged him to engage in "extraordinary," "irreverent" and "controversial" topics. Garbus and CBS could not immediately be reached for comment. But the Times quoted CBS as saying: "We terminated Mr. Imus for cause. Based on the comments in question and relevant contract terms, we believe that the termination was appropriate and CBS would expect to prevail in any attempt by Mr. Imus to recover money for his actions."
