Tenants who’ve been sued in Housing Court can face difficulty finding another apartment because they may have been put on a blacklist by a tenant screening company, even when they win their case! I’ve been working with a group of elected officials and housing advocates to change Office of Court Administration’s policy regarding the sharing of information about Housing Court cases. Last month, a suit was filed against the New York State Court System challenging its policy of selling electronic housing court data to credit reporting agencies. The complaint alleges that the sale of this data has a chilling effect on the ability of tenants to assert their rights in Housing Court and therefore violates the First and Fifth Amendments. James Edstrom's Note: The above E-Mail story was sent to us by State Senator Liz Krueger. I always love the work Liz does, she watches out for the residents of New York City. There are many important issues she brought up, but the above I feel is a important issue. Having lived in NYC forever, I have had a few bad landlords. One landlord I had was pretty bad. I complained and complained about a leak over my bed in my duplex. They never would show to repair it and one day I came home and the ceiling collapsed on my bed. Imagine if I had been sleeping at the time. I took them to court to fix and I won. And the gross thing was that the leak was toilet water from the apartment above.

It is not right that landlord-tenant court cases can be sold to these credit agencies. Like Liz says, even if you win you have this scar on your record. It makes landlords scared to rent to you, even when you had a valid issue with your last landlord. Considering we pay the highest rents in the country to live here, it is not right that our issues with a landlord can be sold to credit reporting agencies. We applaud Liz Krueger.
